Yes, it breaks ToS of sending Discord DMs. Proven by discord themself with a tweet from 2018: https://twitter.com/discord/status/1028300393611231233 .

So discord and a discord partner say it breaks (or can lead to breaking) ToS.

Yes that's against discord TOS if something else what I do have to report people when someone broke Discord TOS for many others that includes other provinces like Discord servers.
