California Penal Code Section 632
As the title states I was wondering if discord is considered a "confidential communication". Or if this Penal code even applies to discord.

Discord has a privacy policy that protects your information. Since you consented to their terms of service and privacy policy, they can inspect messaged reported by a user that allegedly violated Discord's Terms of Service/Community Guidelines. However, Discord employees cannot "spy" on you without a report. And, granted, other people cannot spy on you either. You should consult the Discord Terms of Service and Discord Community Guidelines for further information.
As to the subject of jurisdiction, the California Penal Code only has jurisdiction over a person who commits an offense within the limits of the State of California. If a person is spying on your Discord communications, the only entities that have authority to prosecute are the authorities of their jurisdiction. Your local area cannot prosecute a crime committed in another state.
For example, if someone lives in New York and they commit a crime in Vermont, only Vermont authorities can prosecute this crime. Even the authorities governing the victim of an electronic crime cannot prosecute, unless the offender lives within the limits of the prosecuting authority.
