The Online Safety Act (OSA) is a UK law that applies to companies like Discord and carries certain obligations regarding illegal content, including non-consensual intimate imagery (NCII), sometimes referred to as "revenge porn" or "image-based sexual abuse." Under the OSA and relevant codes of practice, covered platforms, like Discord, must provide a clear reporting process, review qualifying removal requests, remove NCII content, and use tools such as hash-matching to help prevent that content from being shared or re-uploaded.
What this article covers:
Our Responsibilities Under the OSA
If you are affected, you, or a representative acting on your behalf, may:
- Notify Discord of any non-consensual intimate image published on Discord that depicts you and was shared without your consent; and,
- Submit a request for Discord to remove the content. For more details about how to submit a removal request, you can refer to our help article.
So that we can help you, please make sure your removal request meets these requirements:
- You are identifiable in the content or via the context in which it is displayed (for example, your face is visible or your name is mentioned);
- The content shows you nude, partially nude, or engaged in sexual activity; and,
- The content was shared without your consent.
Discord may also action content submitted for removal through this process even if it does not meet the criteria above, such as for violation of our Community Guidelines, or where other UK laws may apply. Discord also reports content that it reasonably believes depicts persons under the age of 18 years old to the National Center for Missing & Exploited Children, and takes enforcement action against users who post such content.
Under the OSA, Discord, as a regulated service, is required to:
- Maintain a clear and accessible process that allows an affected individual (or their authorised representative) to report non-consensual intimate imagery;
- Review each report and assess it against illegal content requirements;
- Remove the reported content confirmed to be illegal NCII within the 48 hour time period required by law; and,
- Make reasonable efforts to identify and remove known copies of the same non-consensual intimate visual depiction.
What to Expect After You Submit a Removal Request Under the OSA
We will promptly review your report to assess whether the content meets the legal requirements for removal. If your report is complete and the content is confirmed to be non-consensual intimate imagery, we will remove it and take reasonable steps to prevent known copies from being re-shared, including through hash-matching where applicable.
If your submission is incomplete, we may be unable to process your report until sufficient information is provided.
